On April 10, 2007, applicant filed a notice of appeal, and the Board instituted the appeal on the same date. The Board issued a decision on the merits of the appeal on October 23, 2007.

It has come to the attention of the Board that on September 13, 2007, approximately three weeks after applicant filed its reply brief, applicant filed an abandonment of its application in TEAS (Trademark Electronic Application System). Applicant did not inform the Board of its abandonment.

In view of the earlier abandonment of the application involved in this appeal, the Board’s October 23, 2007 decision is VACATED.
